Ian Pierce, accused of drink-driving, claims Oswestry Magistrates Court has no jurisdiction in his case because the alleged offence occurred in Weston Rhyn, a village he says is part of the ancient Lordship of Wiggington.
He said the ancient Marcher Lords had absolute authority to make laws in their areas and that the Lordship of Wiggington had never been included in the Active Union [sic] of 1535 [sic, eto] that would take it into the jurisdiction of England.
Subsequent laws including the Welsh Language Act of 1993 and the Local Government Act of 1972 also meant that this area was not included under normal English law.
Mr Pierce maintains, although the law painstaking lists scores of Lordships and annexes them to in either Welsh or English counties, nowhere within the Act of Union is mentioned the Lordship of Wiggington.
The case continues.
